Bus Crash Victim’s Families File Personal Injury Suits Against Trucking Company and Others

Attorneys representing the estates of three individuals who died in a fiery bus crash that included students on their way to school have filed three wrongful death lawsuits against the trucking company and others who were allegedly involved in the fatal accident. On June 11, representatives for the victims sued a trucking company, a bus company, and several individuals who were involved in a crash that occurred on Interstate 70 westbound.

According to the crash report, a charter bus, a Nissan Murano, a Toyota Highlander, and Volvo truck were driving west on Interstate 70 and slowing down for stalled traffic when the semi-truck struck the Murano, forcing the vehicle into the back of the bus before the semi-truck pushed it out into the road, striking the back of the bus. The chain reaction forced the bus into the Highlander, which hit the Volvo before the Highlander spun out into the left lane. The bus ultimately struck the rear of the Volvo.

The crash resulted in a massive fire pouring from the bus which was carrying students to an event in Columbus, OH. Three people on the bus died including a 15-year-old student. 20 individuals were ultimately taken to hospitals. Three people in a passenger car were also pronounced dead.

Elements of negligence 

It is an unfortunately common occurrence to hear of this type of accident. In this case, traffic had slowed down ahead of the semi-truck, but the semi-truck driver failed to sense the stalled traffic in time and rear-ended a vehicle that had already stopped. This is the most common type of truck accident lawsuit that you will see filed. This scenario describes the greater portion of all truck accident lawsuits.

In this case, the driver of the vehicle who did the rear-ending is 100% at fault for the accident. There’s no good reason why the driver could not have stopped in time. Further, it sounds like he struck the bus at a high rate of speed meaning he had barely slowed down.

One thing to understand about large semi-trucks is that they cannot stop on a dime. Instead, they roll to a stop slowly. A semi-truck driver’s reaction time, therefore, must be better than the average commuter. Semi-truck drivers must be able to anticipate stops.

Ultimately, both the truck driver and the company that he works for is responsible for the collision. The company takes on liability for the conduct of its employees. In other words, if an employee commits negligence, then the company commits negligence too. The company and the employee ultimately function as a single entity.
