Man Sues Harley-Davidson After Motorcycle Accident

A Midland man has filed a personal injury lawsuit after he lost part of his leg in a motorcycle crash. The named defendants in the lawsuit are Harley-Davidson Motor Co. and the Odessa dealership that sold him the motorcycle.

According to the lawsuit, the plaintiff bought a 2023 Harley FLTRXSE CVO in March brand new from Legacy Motorcycle. He began experiencing electrical problems with the motorcycle shortly after purchase. Attorneys for the plaintiff say that the phone and radio cut out and on at least one occasion, the motorcycle lost power due to an electrical or computer problem.

The plaintiff contends that he took the bike back to Legacy on three or four occasions ultimately telling them he didn’t want the vehicle any longer, the lawsuit stated. Legacy told the plaintiff it wasn’t a big problem and could be fixed, but never fixed it. Legacy did not mention any defects or recalls with the motorcycle.

According to the lawsuit, the plaintiff was thrown from the motorcycle when it “suddenly and without warning lost power.” As a result of the accident, he sustained “severe catastrophic injuries” that included the amputation of his right leg below the knee.

The plaintiff is seeking more than $1 million in compensatory and punitive damages alleging that Legacy committed both negligence and gross negligence when they sold him the bike. He also contends that Harley-Davidson is responsible for manufacturing a defective motorcycle.

Injuries and damages

 The plaintiff sustained severe, life-altering injuries as a result of the accident. According to the lawsuit, part of his leg had to be amputated below the knee. This will permanently change the plaintiff’s quality of life. If there are any recreational activities that he was involved in, like playing tennis or bowling, this injury will likely prevent him from doing those activities in the future.

Further, if his job required him to perform manual labor, he may no longer be able to do his job effectively. This means that he won’t have income coming in. He deserves to be compensated for that loss and others.

The plaintiff can also be compensated for any medical expenses he incurred as a result of the motorcycle’s engine suddenly turning off.
