Plaintiff Suffers Severe Injuries After Being Rear-Ended by Semi-Truck

A Georgia man has filed a $10 million personal injury lawsuit against a trucking company after he was badly injured when his pickup truck was rear-ended by a semi driven by an amusement park rides company. The lawsuit, which was filed on June 6th in Georgia, was moved to federal court according to documents in the case. According to the lawsuit, a truck driven by Awesome Amusements Inc. suddenly and without warning of any kind rear-ended the plaintiff’s vehicle on March 27, 2023 on I-16 West of Savannah after the plaintiff had slowed due to stalled traffic. Awesome Amusements is based in Florence, SC.

The lawsuit contends that the plaintiff’s head struck and shattered his pickup’s back window, causing him to suffer a range of injuries. The plaintiff is now disabled, has required extensive medical care, surgeries, and therapy costing hundreds of thousands of dollars, and will need further care moving forward.

The lawsuit further contends that the driver was following too closely, speeding, and engaging in activities that distracted him. The suit also names Awesome Amusement and Connecticut-based THE insurance company. The suit also lists another defendant named only John Doe who may have contributed liability to the accident because his truck ran out of fuel, resulting in a blocked traveling on I-16 at exit 143.

The plaintiff’s lawsuit is seeking $10 million in damages plus legal fees and punitive damages.

Truck accidents in rear-end collisions 

This is a common type of truck accident. The driver of a semi-truck is either tailgating another driver or fails to stop in time which causes a rear-end collision. In fact, semi-trucks can’t stop on a dime like a typical commuter vehicle can. Instead, these trucks roll to a stop so the driver must be that much more aware of traffic in front of him. In the case mentioned above, the driver of the semi-truck failed to slow down in time for stalled traffic. He thus crashed his semi-truck into the plaintiff’s vehicle causing the plaintiff severe injury. In this case, the semi-truck driver has a duty of care to ensure that they are maintaining a proper lookout and responding to changes in traffic. In this case, the truck driver failed, causing an accident that severely injured the driver.

Every driver owes every other driver on the road a duty of care to ensure they’re operating their vehicle in a safe manner. When it comes to commercial trucks, their drivers owe the public an expanded duty of care since their vehicles are quite a bit more dangerous. In the case mentioned above, the driver failed to keep a lookout and crashed his semi into the back of a pickup truck. The semi-truck driver is at fault for the accident.
